Regulations | Apartments Pod Orłem - rules of booking and accommodation

Terms and Conditions apply to Apartamenty pod Orłem, hereinafter referred to as the Property.
The Property is managed by Anna Dobrowolska (Tuwima 3/6, 34-500 Zakopane, NIP 6792766369, REGON 120428245).
Persons staying at the Property are hereinafter referred to as Guests.
The person making the reservation and payment for the reservation is hereinafter referred to as the Booking Person.

I Basic information

1. Making a reservation constitutes confirmation that the Guest has read these Terms and Conditions, accepts them, and agrees to comply with their provisions.
2. Guests staying at the Property are also required to comply with health and safety regulations and fire safety regulations and, in exceptional situations, to follow the instructions of the Property staff.
3. In the event of a violation of these Terms and Conditions, the Property has the right to refuse further services to the Guests who violate them. Such persons are obliged to immediately comply with the requests of the Property staff, settle payments for services already provided, pay for any damage or destruction caused, and immediately leave the Property premises.
4. By making a reservation, the Booking Person agrees to the processing of personal data solely for the purpose of completing the reservation and fulfilling the registration obligation in accordance with the provisions of the Act of 29.08.1997 on the Protection of Personal Data. The Booking Person has the right to access and update their personal data.
5. Reservations are made in the name of the person or company that will make the payment.
6.Only persons registered at the Property are entitled to use the Property. The Guest may not transfer the rented room or apartment to other persons, even if the period for which the fee has been paid has not yet expired.
7. Due to fire safety regulations, the use of open flames, heaters, or other electrical devices not belonging to the apartment equipment is prohibited in rooms, apartments, and their surroundings. This prohibition does not apply to chargers and power supplies for electronic or computer devices.
8. The Guest bears full financial and legal responsibility for any damage or destruction of apartment equipment, furnishings, or devices caused by the Guest or their visitors.
9. If any discrepancies between the inventory list and the actual condition or any damage are noticed, this must be reported to the reception immediately after check in. Otherwise it will be assumed that the equipment was complete and undamaged.
10. Guests are particularly obliged to:
a. maintain order and cleanliness in the apartment or room, as well as on the balcony or in the garden;
b. segregate and dispose of waste in the external waste containers;
c. use the Property equipment in a manner that does not cause damage or deterioration.
11. If damage requiring repair or replacement is found in the apartment, room, Property, or common areas, or if excessive dirt requiring specialist cleaning is found, for example sofa cleaning or stain removal from bedding, or if waste is left behind, not segregated, or not disposed of, the Guest will be charged the additional cost of repairs and cleaning. After prior notification, the amount will be deducted from the security deposit held as a card preauthorization. If the amount exceeds the deposit, the Guest is obliged to pay the remaining balance.
12. The liability of the Property for loss or damage to items brought by Guests into the apartment is governed by Articles 846 to 849 of the Polish Civil Code.
13. The apartment or room is inspected by a staff member before check in and after check out.
14. Check in time starts at 15:00 and check out time ends at 11:00.
15. Check in after 20:00 and check out before 8:00 must be reported in advance and agreed with the Reception.
16. Smoking and walking in ski boots are strictly prohibited on the Property premises.
17. Quiet hours apply from 22:00 to 7:00.
18. Users of apartments and rooms must behave in such a way that during quiet hours they do not disturb other Guests in any way, and during the day their behavior must comply with social norms and respect the right of others to rest.
19. The Property has the right to terminate the Agreement with immediate effect without refund if the Guest, persons staying in the apartment, or an animal violate these Terms and Conditions, behave aggressively, or disturb the peace of third parties, including residents of neighboring apartments, especially by organizing parties or gatherings that violate social norms and good conduct. If the Police, Municipal Guard, building security, or a Property employee must intervene, the Property will charge the Guest an additional fee of 1000 PLN for each violation. This does not limit the right to claim compensation under general legal provisions.
20. If the Property determines that the Terms and Conditions have been violated, including complaints from neighbors, building administration, or the Police, or in the event of non payment for the stay, a Property employee is entitled to enter the apartment after attempting to notify the Guest by phone beforehand.
21. Unregistered persons may stay in the apartment or room between 7:00 and 22:00.
22. The presence of unregistered persons in the apartment after 22:00 is considered consent by the Booking Person for paid accommodation of those persons. The cost for each additional person is 100 PLN per night.
23. The Property accepts small and medium sized dogs for an additional fee.
24. The stay of a dog in the apartment must be reported immediately after making the reservation to determine the additional fee. The Property reserves the right to refuse stays with animals other than dogs, with more than one dog, with large dogs, or dogs classified as aggressive breeds.
25. Children and minors under 18 may stay only under the supervision of adults who assume full responsibility for their behavior and any consequences.
26. Reservations and stays by minors aged between 13 and 18 are possible only with written consent of a legal guardian sent by email. If during check in or the stay it is determined that the Booking Person is a minor, the Reception will contact the legal guardian for confirmation of the agreement and allow three hours to receive confirmation. If confirmation is not received, the agreement will be considered not concluded.
27. According to the amendment to the Family and Guardianship Code of 15.02.2024 regarding the protection of minors, the Property implements Child Protection Procedures and requires Guests staying with a child to possess a document confirming that they are legally responsible for the child. This may include the child's ID showing family relation, a civil status document, court decision, notarized parental consent for travel, or written parental consent containing the child’s details, address, parent’s contact number, and the ID or PESEL number of the person responsible for the child.
28. For the safety of all users, staff may request access to the room whenever necessary.
29. The Property reserves the right to refuse accommodation to persons visibly under the influence of alcohol or drugs or behaving in a vulgar manner.
30. Waste segregation is mandatory in the apartments in accordance with local municipal regulations. If waste is not segregated correctly, the Property may charge an additional fee of 100 PLN.
31. The Property is not responsible for items left in the apartment or room after check out.
32. The Property is not responsible for utility failures, power, water, or heating outages, equipment malfunctions, or other events beyond its control, including administrative actions or natural disasters.
33. Guests are prohibited from using electrical outlets to charge electric vehicles.

II Additional fees

1. The price of the stay does not include the local city tax collected during check in and transferred to the municipal authority, or other additional fees.
2. Payment for the stay and the local tax of 2 PLN per person per night are collected on the day of arrival at check in.
3. One child up to 3 years old per two adults stays free of charge if sleeping in the existing bed.
4. The one time fee for providing a baby travel cot is 40 PLN per stay.
5. The fee for staying with a dog is determined individually after notifying the reception.
6. Other fees such as early check in, cleaning during the stay, or linen and towel replacement are arranged with the reception and depend on availability.
7. On arrival a security deposit will be collected in the form of a card preauthorization of 500 PLN or 800 PLN. During Christmas, New Year’s Eve, and New Year period the deposit is 1000 PLN. If no damage is found, the deposit will be released within 7 days after check out.
8. A parking space is available for an additional fee. Only one parking space may be purchased per apartment. Parking is allowed only in designated areas, either in the garage or on the property depending on the apartment. The Property owner is not responsible for vehicles or items left in them.

III Online reservations

1. Online reservations can be made via the website www.podorlemzakopane.pl
2. To confirm a reservation the Booking Person must pay a deposit of 40 percent of the total reservation value for the standard offer or 100 percent for the non refundable offer within 48 hours of booking. If the reservation starts the same day, payment must be made within one hour. The remaining balance, local tax, additional fees, and deposit are paid at check in.
3. For selected apartments, if the reservation includes the period between 20 December and 3 January, full payment for the stay is required. In case of cancellation the payment is non refundable. Failure to pay within the specified time results in cancellation of the reservation.
4. For reservations made on the day of arrival the deposit equals 100 percent of the reservation value.
5. Payments are made via the PayU payment system available in the booking panel or by traditional bank transfer.
6. The same cancellation and complaint rules apply to online reservations as to reservations made by other methods.

IV Changes to reservations

1. Payment of the deposit constitutes acceptance of these reservation conditions.
2. Failure to pay the deposit within the agreed time results in cancellation of the reservation.
3. If a confirmed reservation is cancelled, the deposit is retained by the company Anna Dobrowolska.
4. Changing the stay date after paying the deposit is possible only once and must be done at least 14 days before the planned arrival date. The change may only be made once for the same apartment at the same price while maintaining the original length of stay. If the new date falls in a higher season, the price difference must be paid. The deposit must be used within 90 days from the original reservation check in date.
5. In case of no show without cancellation, the deposit is non refundable and cannot be used for another reservation.
6. The stay may be extended if the apartment is available. The reception must be informed by phone or email to arrange payment for the additional night.
7. The client may transfer all rights from the reservation to another person provided that the new person accepts all obligations arising from the reservation. The reception must be notified immediately.

V Voucher

1. The voucher can be used within 12 months from the date of purchase. After this period it is considered used.
2. The voucher can be used only once and requires prior reservation with the voucher number.
3. Please contact the reception in advance by phone or email quoting the voucher number to confirm availability.
4. The printed voucher must be handed to the reception upon arrival.
5. Conditions for change or cancellation are defined in the Terms and Conditions of Apartamenty pod Orłem where the reservation was made.
6. The voucher has no cash value and cannot be refunded or exchanged for cash.
7. The voucher may be used only once and cannot be divided.

VI Complaint procedure

1. Guests have the right to submit complaints regarding services provided by the Property.
2. The Property accepts complaints only by email sent to kontakt@podorlemzakopane.pl within 14 days from the end of the stay. If the stay did not take place on the booked date, the complaint must be submitted within 14 days from the planned end date.
3. The Property reserves 14 days to review the complaint and inform the Guest of the result.

VII Additional information

1. Parking space can be purchased for addicional fee. Spaces are located either in the garage or on the property. Parking is allowed only in designated places. The Property owner is not responsible for vehicles or items left in them.
2. Free WiFi Internet is available in the apartment or room. The Property is not responsible for interruptions in internet access or for any actions of guests online.
3. Certain areas of the Property may be monitored to ensure the safety of guests and property.

Animal policy

1. Small and medium sized dogs are allowed in selected apartments.
2. An additional fee is charged for a dog, determined individually.
3. Only healthy animals with a valid health booklet confirming vaccinations and deworming are allowed.
4. Any damage or dirt requiring additional staff work caused by the dog will be individually assessed and charged to the owner.
5. Owners are responsible for ensuring that their animals do not disturb other Guests. If complaints are received, the Property reserves the right to ask the owner to leave the building without refund.
6. In common areas dogs must be kept on a leash.
7. The owner must clean up after the animal at all times.
8. The arrival with a pet must be reported at the time of booking. Failure to inform the Property may result in refusal of the animal’s stay.
9. The Property reserves the right to refuse animals, especially those classified as aggressive breeds including American Pit Bull Terrier, Majorca Dog, American Bulldog, Dogo Argentino, Canary Dog, Tosa, Rottweiler, Akbash Dog, Anatolian Karabash, Moscow Watchdog, Caucasian Shepherd Dog in accordance with the Regulation of the Minister of Interior and Administration of 28 April 2003 regarding the list of aggressive dog breeds.
